Agreement to Terms
These Terms of Service ("Terms") are a legal agreement between you and Gasworks Media LLC, a Washington State limited liability company ("Cochago", "we", "us", or "our") governing your use of the Cochago AI receptionist service.
By using Cochago, you agree to these Terms. If you do not agree, do not use the service.
Description of Service
Cochago provides an AI-powered virtual receptionist service that:
- Answers phone calls and website chat inquiries on your behalf
- Qualifies leads and captures customer information
- Books appointments into your calendar (Book plan and above)
- Detects emergencies and alerts your team
- Provides transcripts and summaries of conversations
Your Responsibilities
You agree to:
- Provide accurate information about your business
- Comply with all applicable laws, including telemarketing and privacy laws
- Not use Cochago for illegal, fraudulent, or harmful purposes
- Not misrepresent the AI as a human (the AI will always identify itself)
- Maintain the confidentiality of your account credentials
- Pay all fees when due
AI Disclosure
Cochago's AI assistant will identify itself as an AI at the start of every conversation. You agree not to configure the AI to claim it is human.
Prohibited Uses
You may not use Cochago to:
- Violate any laws or regulations
- Collect data without proper consent
- Send unsolicited communications (spam)
- Harass, abuse, or harm others
- Infringe on intellectual property rights
- Transmit malware or malicious code
- Interfere with the service's operation
Payment and Billing
- Pricing: Current pricing is available at cochago.com/pricing.
- Billing: Subscriptions are billed monthly in advance.
- Trials: Free trials do not require a credit card. Trials convert to paid subscriptions only if you provide payment information.
- Cancellation: You may cancel at any time. Your service continues until the end of the billing period.
- Refunds: We do not provide refunds for partial months.
Intellectual Property
- Our IP: Cochago and its technology are owned by Gasworks Media LLC. You receive a limited license to use the service.
- Your Content: You retain ownership of your business content and customer data.
- AI Training: We may use anonymized, aggregated data to improve our AI models. Your specific conversations are not shared with other customers.
Privacy
Your use of Cochago is subject to our Privacy Policy at cochago.com/privacy.
Disclaimer of Warranties
COCHAGO IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS.
THE AI MAY OCCASIONALLY PROVIDE INCORRECT OR INCOMPLETE INFORMATION. YOU ARE RESPONSIBLE FOR VERIFYING IMPORTANT INFORMATION WITH YOUR CUSTOMERS.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Gasworks Media LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify and hold harmless Gasworks Media LLC from any claims, damages, or expenses arising from your use of Cochago or violation of these Terms.
Termination
- By You: You may cancel your account at any time.
- By Us: We may suspend or terminate your account for violation of these Terms, non-payment, or for any reason with 30 days notice.
- Effect: Upon termination, your access ends and your data will be deleted according to our Privacy Policy.
Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by email or through the service. Continued use after changes constitutes acceptance.
Governing Law
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules.
Dispute Resolution
The exclusive venue for disputes will be the state and federal courts located in Washington, unless applicable law requires otherwise.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Cochago.
